To qualify for Social Security disability benefits, you must have a medical condition severe enough to qualify under SSA guidelines. The most direct way to meet these guidelines is if you meet or equal in severity the impairments set forth in a specific SSA listing. Under SSA there is both Social Security Disability Insurance and Supplemental Security Income.

Social Security Disability Insurance (SSDI) benefits are available to workers who are insured under SSDI. To be considered “insured” for purposes of receiving these benefits, you must have earned enough credits during your work.

Supplemental Security Income (SSI) is a program that pays benefits based upon financial need where you do not have insured status under SSDI. You must meet the same medical criteria under SSDI and, in addition, meet a financial hardship test.

Many companies provide disability insurance policies for their employees through plans set up under the Employee Retirement Income Security Act (ERISA) of 1978. The “Plan” will set out the procedures required to contest a denial of a disability claim. There will be an administrative review of your claim that you must go through as an initial step in contesting denials. If you do not prevail in the administrative phase of the claim you may then contest the denial in court.

You may receive disability benefits if you have purchased a disability plan from a private insurance company. There are both short-term and long-term disability benefits. The standard typically, although not always, used in these policies is an “own occupation standard”. If your condition prevents you from performing the substantial and material duties of my own occupation then you may qualify for benefits.
